TERMS AND CONDITIONS
    
    Welcome to FamFlix!
    The FamFlix service is provided by Canal de Comunicación Creativa, S.A. de C.V. (hereinafter referred to as the “Company”).
    
    
I. CONTRACTUAL RELATIONSHIP.
    
    These Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) govern the use by the User of the Services offered or that may be offered through the website http://famflix.mx and/or the digital application named FamFlix (Android) and FamFlix+ (iOS), as well as Apple TV and Android TV (hereinafter referred to as the “Portal”).
    
    Consequently, any person wishing to use the Services offered on the Portal must carefully read these Terms and Conditions beforehand. The Company reserves the right to modify, add, or remove these Terms and Conditions unilaterally at any time. In such case, the Company will notify the User of such changes through a notice on the Portal. Likewise, the Company may modify the configuration of the Portal and/or the Services offered therein without prior notice to the User.
    Access to or use of the Portal and/or the Services constitutes acceptance of these Terms and Conditions, thereby establishing a contractual relationship between the User and the Company.
    
    The User acknowledges that by clicking the “accept” checkbox, they agree to these Terms and Conditions and their legal effects, in accordance with Articles 80 of the Mexican Commercial Code and 1803 of the Federal Civil Code. If the User does not fully accept these Terms and Conditions, they must refrain from clicking “accept.” Notwithstanding the foregoing, certain Services may be subject to specific conditions that supplement or modify these Terms and Conditions (hereinafter referred to as “Specific Agreements”). Before using such Services, the User must review the applicable Specific Agreements made available through the Portal.
    
    
II. DESCRIPTION OF SERVICES.
    
    Through the Portal, the Company offers a subscription service that allows Users to access audiovisual content (hereinafter referred to as “FamFlix Content”) transmitted over the Internet (the “Services”).
    The Portal, including all FamFlix Content, is owned by the Company and protected by Mexican and international Copyright and Intellectual Property laws.
    
    
III. MEMBERSHIP.
    
    To use the Services, the User must have Internet access, create a User account, and provide a valid payment method, which may be updated at any time (hereinafter referred to as the “Payment Method”). The membership will remain active unless canceled prior to the billing date to avoid being charged for the following month.
    
    The information provided by the User to create their membership must be truthful. The User acknowledges that any trust placed in the creation of their account is at their own risk. Nevertheless, the Company will treat such information confidentially.
    
    
IV. FREE TRIAL PERIOD.
    
    If you meet the eligibility criteria determined at the sole discretion of the Company, your FamFlix membership may begin with a free trial period (as available at the time). The Company may limit or revoke the free trial to prevent misuse. Examples of ineligibility include: (i) households already holding a FamFlix account; (ii) device identification; (iii) email address; (iv) account holder’s name; among others.
    
    Once the free trial period ends, and if you have not canceled your account, the Company will charge your Payment Method the applicable rate corresponding to the plan associated with your promotion.
    
    
V. BILLING.
    
    Service fees and any related charges, including applicable taxes, will be billed monthly to your Payment Method on the calendar day corresponding to your account creation date. If payment cannot be processed successfully for any reason, access to the Services will be suspended until a valid payment is received.
    
    You may update your Payment Method at any time. By doing so, you authorize the Company to continue charging Service fees and remain responsible for any unpaid balances. The Company shall not be liable for any charges imposed by your Payment Method issuer.
    
    You may cancel your FamFlix membership at any time. However, upon cancellation, you will continue to have access to the Services until the end of your current billing cycle, according to your plan. Please note that the Company does not offer refunds or credits. To cancel, follow the subscription management process in the store where you subscribed (Apple Store, Google Play, or PayPal). If you subscribed via the website, cancellation must be done through the cancellation module in your profile.
    
    
VI. TAXES.
    
    Each User and the Company acknowledge that they are individually responsible for paying their respective taxes under applicable law. The Company is not responsible for fulfilling any User tax obligations.
    
    
VII. SERVICE REQUIREMENTS.
    
    In addition to the provisions of these Terms and Conditions, the following shall apply:  
    (i) To use FamFlix Services, the User must have the legal capacity to enter into binding contracts and be of legal age in their country of residence.  
    
    (ii) FamFlix Content is for personal use only and may not be commercialized. In exchange for your subscription, the Company grants you a limited, non-exclusive, non-transferable license to access the FamFlix Services through streaming.  
    
    (iii) You may use the FamFlix Services only in the country where your account was created or in regions where the Company officially offers its Services.  
    
    (iv) The number of devices that can access FamFlix Services depends on your subscription plan.  
    
    (v) You agree to use the Services in compliance with applicable laws and regulations in Mexico and your country of residence. You agree not to store, reproduce, distribute, modify, publish, license, create derivative works, or sell any FamFlix Content. You also agree not to: remove, alter, disable, or interfere with content protections; use automated means to access Services; decompile, reverse-engineer, or disassemble any software or process; insert code or manipulate content; or use any data extraction or scraping methods. You must not upload or transmit any material designed to damage or disrupt the Services, including viruses, malware, or harmful code.  
    Violation of these provisions may result in suspension or termination of access without prior notice.  
    
    (vi) Image quality may vary depending on the device and Internet connection. For optimal performance, a minimum download speed of 20 Mbps is recommended. The Company is not responsible for Internet access charges, which are the User’s responsibility.  
    
    (vii) If a User fails to comply with these Terms and Conditions, the Company reserves the right to remove access to the Portal and/or Services, and delete any content deemed illegal, abusive, offensive, defamatory, discriminatory, or otherwise contrary to applicable law, morality, or public order.  
    
    (viii) The User shall not engage in any act through the Portal or Services that violates Mexican law or other applicable regulations.  
    
    
VIII. PASSWORD AND ACCOUNT ACCESS.
    
    The Account Holder is the member who created the FamFlix account and is billed for Services. The Account Holder has control over the FamFlix account and any associated devices. To maintain control, the Account Holder must keep their password and payment details confidential. The Account Holder is responsible for keeping their personal information accurate and updated. If the Company suspects identity theft or fraudulent activity, it may suspend or cancel the account to protect the User.
    
    
IX. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY.
    
    The Services are provided “as is” without any warranties or conditions. You waive all special, indirect, and consequential damages against the Company. Nothing in these Terms shall limit any non-waivable consumer rights available under applicable law.
    
    
X. MISCELLANEOUS.
    
    (i) Governing Law. These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Mexican States. The User and the Company agree to submit to the exclusive jurisdiction of the competent courts of Mexico City, expressly waiving any other jurisdiction that may apply.

    (iii) Severability. If any provision of these Terms and Conditions is declared null, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable.  
    
    (iv) Electronic Communications. All information related to your account will be sent electronically to the email address provided during registration.
